Government urges High Qualification Commission of Judges of Ukraine and High Council of Justice to publicly check the actions of judges who block the appointment of chairmen of state-owned enterprises

The Cabinet of Ministers of Ukraine will appeal to the High Qualification Commission of Judges of Ukraine and the High Council of Justice with a demand to conduct an open verification of the actions of judges who took decisions that block the appointment of CEOs to state-owned enterprises, those to be selected through open public competitions. This was stated by Prime Minister of Ukraine Volodymyr Groysman during a meeting of the Government on Wednesday, May 18.

"I will sign today this appeal to the High Qualification Commission of Judges of Ukraine. We will ask the High Qualification Commission and the High Council of Justice not to be indifferent, to consider these issues and to inform the public. I think it's rather important from the point of view of trust to the High Qualification Commission, to the High Council of Justice by the society," stressed Volodymyr Groysman.

The Head of Government noted that in Ukraine there had been launched public contests with the Nomination Committee to select chairmen of the public enterprises. They have managed to appoint a few candidates, but “with regards to many of such enterprises, which belong to the Ukrainian people, the courts, the judiciary authorities are blocking the holding of such competitions, which is absolutely unacceptable," he urged.

Volodymyr Groysman gave examples of enterprises SE Ukrspyrt and PJSC Centrenerho, with billions assets, and in which today’s rulings of courts blocked the competitions.

"I think certain judicial officials want to leave things the way it was, as usual. Not going to be the same, said Volodymyr Groysman. “Until now, state-owned enterprises remain a source of corruption as leaders aren’t appointed transparently. This situation must change".

The Prime Minister emphasized that the Ukrainian Government would respond to such cases of incorrect decisions issued by judges, inform publicly which courts or officials adjudge and would appeal for such information to justice authorities. "The Government will do everything to make this information public knowledge. We will not hide anything and will fight to protect each particular right to public appointment," he said.

"I wish that honest representatives of the judiciary could understand that we share the same views with regard to the desire to completely destroy any old schemes. But regarding all those who consider they may declare in the name of Ukraine their personal decisions, we will provide legal treatment in line with Ukrainian legislation", stressed the Head of Government.

Volodymyr Groysman called on the Ministry of Justice to continue the analysis and monitoring of illegal rulings by judges, those hampering the competition process. He also appealed to MPs to join an initiative to disclose information about such cases. "Such shameful decisions that allow them to exploit state-owned enterprises should get public and legal assessment", highlighted the Head of Government.

Moreover, the Prime Minister noted that the outdated, flawed judiciary "which allows to deliver rulings, depending on how events transpire" must be changed to restore the trust of Ukrainian citizens.
