The Cabinet of Ministers of Ukraine, in the framework of implementation of a government's initiative to eliminate any pressure on honest business by law enforcement and controlling bodies, has drafted a number of amendments to the legislation aimed to protect entrepreneurs and strengthen the responsibility of authorities for unlawful actions against entrepreneurs. This was announced by Prime Minister of Ukraine Volodymyr Groysman.

He emphasized that the changes had been prepared by an interagency group of specialists from the Ministry of Justice, the Ministry of Internal Affairs, the Office of the Business Ombudsman, etc. and take into account the demands voiced by business representatives in September during a meeting with the President, the Head of Government and the Prosecutor General. Volodymyr Groysman reminded that a series of important regulatory decisions had already been adopted following the meeting, and thanked the President of Ukraine and the Prosecutor General for their introduction.

“During the meeting, I promised that the Government would table an initiative of creating a legislative framework to disable any kind of pressure on entrepreneurs. I'm talking about honest business structures...,” stressed Volodymyr Groysman, “Our priority includes creating startups and development of effective enterprises. Thus, the economy will become stronger; therefore, Ukraine will become stronger, while all those who impede doing so will incur responsibility."

The draft government acts, first of all, envisage the establishment of a legitimate and mandatory video record of a court decision on conducting searches and the inadmissibility of adjudging without a lawyer. It also provides for a ban on the seizure of original financial documents, servers, computers and telephones of entrepreneurs during searches and obligatory video recording of such searches. Moreover, it is banned to open several similar criminal cases against one entrepreneur and it is introduced a liability of law enforcement officers for illegal actions against entrepreneurs.

“Next year we will provide economic growth of over 3%, but we must ensure this showing at the level of 5-7% at the least and create proper conditions for the development of economy and entrepreneurship,” the Head of Government stressed, commenting on the need for adoption of changes. “I hope that in synergy with the President and the Parliament, we will have a chance to trigger necessary changes by the end of year.”
